Motor vehicle accidents: DUI suspected in crash

Police in Fort Collins responded to a serious crash in the northbound lanes of Interstate 25 on the night of Feb. 16. The Colorado State Patrol confirmed that four people were injured in the crash, and there is some question as to whether one of the contributing drivers was drunk behind the wheel. However, as with many motor vehicle accidents, charges will not be filed until the police investigation is complete. 

According to the report filed by the CSP, around 7:15 p.m. traffic on I-25 began to slow down. The 34-year-old male driver of a pickup truck reportedly failed to slow down in tandem with the other vehicles on the road, causing him to crash into the back of a passenger car. The force of the impact caused a chain reaction, with the car rear-ending another pickup truck, which in turn struck an SUV. 

The driver of the passenger car suffered life-threatening injuries and was rushed to a local hospital. The initial driver who appears to have caused the crash suffered only minor injuries. The driver and passenger in the second pickup truck also suffered minor injuries, and everyone else involved was not injured. Police are still investigating their belief the responsible driver may have been intoxicated.

If this proves true, he could face fines and even jail time, as motor vehicle accidents caused by DUI are clearly preventable. Even if he is not found guilty, the injured parties are entitled under Colorado law to file personal injury lawsuits against him in civil court. If his negligence in connection with the accident can be proven, sometimes using evidence gathered by police, the court award damages to those injured.
