Motor vehicle accidents: Child killed in Colorado

A 1-year-old child was killed in a recent serious crash that is being blamed on an improper pass, according to local authorities. Colorado State Patrol have not determined whether they will file charges against the 23-year-old woman believed responsible for the accident. As with most motor vehicle accidents, further investigation will likely be required before a decision is reached. 

According to the report filed by CSP, the woman was traveling northbound on Interstate 25 around 3:30 p.m. the afternoon of March 11 when she attempted to use the right lane to pass an SUV traveling the same direction. Unfortunately, her vehicle collided with the SUV when she attempted to re-enter the left lane. The force of the impact sent her vehicle into southbound lanes, where she collided with an oncoming pickup truck. 

Two people in the truck were taken to a local hospital with injuries described as not life-threatening. The conditions of the people in the SUV are unknown at this time. The woman was carrying a 19-month-old child, properly restrained in a car seat, who suffered serious injuries in the crash. The child was pronounced dead a short time later. The woman herself also suffered serious injuries. 

In fatal motor vehicle accidents, criminal charges are filed if Colorado police determine the driver or drivers contributed to the accident through recklessness, negligence, intoxication or a host of other factors. While it is unclear whether charges will be filed in this incident, the family of the deceased child could still have legal recourse. They are entitled to file a wrongful death suit against the driver in civil court, even if the woman is related to the child.
