Motor vehicle accidents: Fatal crash in Colorado

A 33-year-old man is dead following a three-car collision on Interstate 25 near Mesa Ridge Parkway, according to local police. Colorado State Patrol has confirmed the Feb. 13 crash that claimed the life of one man and injured another. Motor vehicle accidents with a clear cause can sometimes result in criminal charges, and police have said charges may be pending in this case. 

According to the accident report, just before 11 p.m. a passenger vehicle rear-ended a southbound SUV driven by the victim. The force of the impact caused the SUV to cross the median into northbound traffic, striking another vehicle headed that direction. The driver of the SUV was ejected from his vehicle and was pronounced dead at the scene by arriving medical personnel. 

The driver of the sedan he hit apparently suffered minor injuries. The condition of the driver who rear-ended the SUV was not mentioned in the report, and it is also unknown whether any passengers were involved in the collision. However, all three drivers are believed to have been wearing seat belts at the time of the accident. The details of any pending charges have not been made clear at this time. 

It seems likely that any charges filed in this crash would be attributed to the driver who rear-ended the SUV, who could face criminal consequences for his or her role in the accident. Motor vehicle accidents causing fatalities are also actionable under Colorado civil law, as the family of the deceased is entitled to pursue a wrongful death lawsuit in civil court. While a criminal conviction is not necessary to see such a civil case successful, evidence of the driver's negligence regarding the crash is a prerequisite for the court to award financial damages to the grieving family.
